Terms of Service

These Terms of Service ("Terms") govern your use of the OpsMate service and triont.com.au website operated by Triont Pty Ltd ("Triont", "we", "us"). By creating an account or using the service, you agree to these Terms.

1. The service

OpsMate is an AI-powered AWS infrastructure intelligence service. It uses a read-only IAM role in your AWS account to query infrastructure metadata and generate health reports, cost analysis, and interactive responses to natural language queries about your environment.

OpsMate is a read-only service. It does not make changes to your AWS environment, does not access application data or database contents, and does not store credentials beyond the read-only role ARN and external ID required for cross-account access.

2. Accounts and access

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your API key. If you believe your API key has been compromised, contact us immediately at support@triont.com.au.

You are responsible for deploying and maintaining the read-only IAM role in your AWS account. You may revoke OpsMate's access at any time by deleting the CloudFormation stack or the IAM role directly. Revoking access does not cancel your subscription — cancel separately via the process described in Section 5.

3. Acceptable use

You may use OpsMate only for lawful purposes and in accordance with these Terms. You must not:

  • Use the service to query AWS accounts you do not own or have explicit authorisation to access
  • Attempt to circumvent usage limits, token quotas, or access controls
  • Use the service in any way that could damage, disable, or impair our infrastructure
  • Resell or sublicense access to OpsMate without our written consent
  • Use the service to process data in violation of applicable privacy laws

4. Billing and payment

OpsMate is billed monthly in advance. Payments are processed by Stripe. By providing payment details, you authorise Triont to charge your payment method on a recurring monthly basis for the plan you have selected.

All prices are in USD unless otherwise stated and are exclusive of GST. GST will be applied to invoices issued to Australian customers in accordance with Australian tax law.

The Starter plan fee ($9.95 USD/month) is credited against your first month's charge if you upgrade to a paid tier within 30 days of signing up.

Token overages on the Enterprise plan are charged at $25 USD per 1 million tokens, billed at the end of each monthly period.

5. Cancellation

You may cancel your subscription at any time by contacting support@triont.com.au. Cancellation takes effect at the end of your current billing period. We do not provide refunds for partial months.

We may suspend or terminate your account if you breach these Terms, fail to pay, or engage in conduct we reasonably determine to be abusive or harmful to our service or other customers. We will provide notice where practical.

6. Data and privacy

Our collection and use of your data is governed by our Privacy Policy, which forms part of these Terms. By using OpsMate, you agree to the practices described in the Privacy Policy.

You retain ownership of your data. By using OpsMate, you grant Triont a limited licence to access, process, and store your infrastructure telemetry and query data solely for the purpose of providing and improving the service as described in the Privacy Policy.

7. Intellectual property

The OpsMate service, including its software, AI models, investigation recipes, and documentation, is owned by Triont Pty Ltd. Nothing in these Terms transfers ownership of any intellectual property to you.

Reports and outputs generated by OpsMate based on your data are yours to use freely. Triont retains the right to use anonymised versions of findings as described in the Privacy Policy.

8. Disclaimer of warranties

OpsMate is provided "as is" and "as available." We make no warranty that the service will be uninterrupted, error-free, or that findings will be complete or accurate. Infrastructure discovery is AI-assisted and may miss issues or produce incorrect conclusions. OpsMate findings should be treated as one input to operational decision-making, not as a definitive audit or compliance assessment.

Nothing in OpsMate's output constitutes security, legal, financial, or compliance advice.

9. Limitation of liability

To the maximum extent permitted by Australian law, Triont's liability for any claim arising from your use of OpsMate is limited to the fees you paid in the three months preceding the claim. We are not liable for indirect, consequential, or incidental damages including loss of revenue, data, or business opportunity.

Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

10. Indemnification

You agree to indemnify Triont against claims arising from your use of OpsMate in violation of these Terms, your violation of applicable law, or your infringement of any third-party rights.

11. Modifications to the service and Terms

We may modify the service or these Terms at any time. We will provide at least 14 days' notice of material changes by email. Continued use of the service after changes take effect constitutes acceptance. If you do not agree to changes, you may cancel your subscription before they take effect.

12. Governing law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
